1) Scope
(1) These Terms and Conditions apply to all orders placed via our online shop.
(2) Our offer is directed exclusively at consumers within the meaning of Section 13 of the German Civil Code (BGB).
2) Contracting Party and Conclusion of Contract
(1) The purchase contract is concluded with Aylin Yüksel Fulya Kokud GbR, Reuderner Straße 81, 72622 Nürtingen, Germany.
(2) The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding online catalogue.
(3) By clicking the “Place order with obligation to pay” button, you submit a binding offer to purchase the goods in your cart.
(4) You will receive an order confirmation by e-mail. This does not yet constitute acceptance of your offer.
(5) The contract is only concluded when we accept your offer by sending a shipping confirmation or by dispatching the goods.
3) Prices, Currency, Taxes and Import Duties
(1) The prices stated in the shop at the time of ordering apply.
(2) All prices are displayed in Euro (EUR).
(3) Unless otherwise stated, prices are final prices.
(4) For deliveries outside the EU, additional customs duties, import VAT, or other charges may apply. These are to be borne by the customer.
(5) All prices are final prices. In accordance with Section 19 of the German VAT Act (UStG – small business regulation), no VAT is charged or shown.
4) Shipping and Delivery
(1) Shipping to you (outbound shipping) is free of charge unless otherwise stated at checkout.
(2) Delivery is made to the address provided during the order process.
(3) Delivery times are indicated on the product page or at checkout.
(4) We ship worldwide and use various carriers depending on destination (e.g. DHL, DPD, Hermes or comparable providers).
(5) If additional costs arise due to incorrect or incomplete address details, refusal of acceptance, or failure to collect the shipment, we reserve the right to charge these costs or deduct them from any refund, within the limits permitted by law.
5) Payment
(1) The following payment methods are available, depending on availability:
- Credit card (via Shopify Payments)
- PayPal
- Klarna (e.g. invoice / Pay Later / Sofort – no installment payments)
(2) Payment processing is carried out via the respective payment provider.
(3) We reserve the right to exclude certain payment methods.
6) Retention of Title
The goods remain our property until full payment has been received.
7) No Pre-Orders
We do not offer pre-orders. Orders can only be placed for products shown as available.
8) Waitlist / Back-in-Stock Notification
(1) For unavailable products, a waitlist or availability notification may be offered.
(2) The waitlist does not constitute a reservation or a purchase offer.
(3) A contract is only concluded through a regular order.
9) Vouchers, Discount Codes and Gift Cards
(1) Discount codes can only be redeemed during checkout and cannot be applied retroactively.
(2) Unless otherwise stated, only one discount code can be used per order.
(3) Cash redemption is excluded.
(4) Gift cards can be redeemed at checkout. Cash payout is excluded to the extent permitted by law.
(5) In the event of withdrawal, refunds are generally made using the original payment method. If a gift card was used, the refund will be issued as store credit.
(6) We assume no liability for loss or unauthorized use of discount codes or gift cards, to the extent permitted by law.
10) Right of Withdrawal
Consumers have a statutory right of withdrawal. Details can be found in our withdrawal policy.
11) Returns / Return Shipping Costs
(1) In the event of withdrawal, you bear the direct costs of returning the goods.
(2) Returns must be registered in advance via e-mail to info@honigwasser.com, stating the order number.
(3) To exercise the statutory right of withdrawal, a clear declaration is required (e.g. by e-mail). Simply returning the goods without notice is not sufficient.
(4) Unregistered returns can only be processed once they have been successfully assigned to an order.
(5) Returns must be sufficiently prepaid and securely packaged.
12) Warranty (Defects)
(1) Statutory warranty rights apply.
(2) In the case of obvious transport damage, please report it directly to the carrier and inform us as soon as possible. Your statutory rights remain unaffected.
13) Liability
(1) We are liable without limitation in cases of intent, gross negligence, and injury to life, body, or health.
(2) In the case of slightly negligent breaches of essential contractual obligations, liability is limited to the foreseeable, typical contractual damage.
(3) Otherwise, liability is excluded to the extent permitted by law.
(4) These limitations of liability also apply to our legal representatives and agents.
14) Consumer Dispute Resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
15) Applicable Law
(1) German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the country in which they have their habitual residence.
16) Final Provisions
Should individual provisions of these Terms and Conditions be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
